Medicare paid my medical expenses from an accident will I have to pay medicare back?


Federal Law imposes a lien on the recovery from any casualty loss for which Medicare paid medical expenses. Insurance companies, lawyers and clients are equally responsible for paying the lien. Medicare is not always an easy partner in the process. The upside to the Medicare lien is the low reimbursement rates. Typically, Medicare liens are small in relation to the severity of the injury and the extent of the treatment.
 
Medicare liens are difficult to negotiate because Medicare is a governmental entity, they tend to take a one size fits all approach. In my experience, Medicare requires the repayment of a greater portion of their lien than do private insurance companies. The Medicare lien process is complicated.
